Welcome to Static Archive. In these Terms of Service, "we", "us" and "our" refer to Static Archive. Static Archive operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a personalised shopping experience (the "Services"). Static Archive is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, including all policies referenced within them (the "Terms of Service" or "Terms"), describe your rights and responsibilities when using the Services.

When you place an order, you are making an offer to purchase. Static Archive reserves the right to accept or decline your order at its sole discretion. Your order is not accepted until we confirm it, and we must receive and process payment before an order is accepted. Please review your order carefully before submitting it, as we may not be able to accommodate cancellation requests once an order has been accepted. If we do not accept, modify or cancel an order, we will attempt to notify you using the contact details provided during checkout.

Returns and exchanges are handled in accordance with our Return & Refund Policy.

You represent and warrant that your purchases are intended for personal or household use only, and not for commercial resale or export.

Article 4 — Pricing and Billing

Prices, discounts and promotions are subject to change without prior notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. Unless expressly stated otherwise, listed prices exclude taxes, shipping charges, handling fees, customs duties and import taxes.

Prices shown in our online store may differ from prices at physical events, pop-ups or other sales channels. Promotions are governed by their own terms, which take precedence over these Terms in the event of a conflict.

All delivery times provided are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs clearance, or events beyond our reasonable control. Title and risk of loss transfer to you once the products are delivered to the carrier.

Our Services — including all trademarks, brand assets, text, imagery, graphics, video, audio, the Static Archive globe logo, and the design, selection and arrangement of the above — are owned by Static Archive, its affiliates or licensors, and are protected by copyright, trademark and other intellectual property laws.

These Terms permit you to use the Services solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent.

The Static Archive name, globe logo, product names and design elements are trademarks of Static Archive. You may not use them without our prior written permission. All rights not expressly granted in these Terms are reserved.

Article 7 — Optional Tools

You may be given access to tools provided by third parties as part of the Services. We do not monitor and have no control over such tools, which are provided "as is" and "as available", without warranties of any kind. Your use of any optional third-party tool is entirely at your own risk.

We may introduce new features or tools to the Services over time. Any such additions will also be considered part of the Services and subject to these Terms.

Article 8 — Third-Party Links

The Services may contain links to websites or content provided by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party material, and we are not liable for any harm arising from your use of third-party websites or products. Please review the terms and policies of any third party before engaging in a transaction with them.

Article 9 — Relationship with Shopify

Static Archive uses Shopify to provide the Services to you. All sales and purchases made in our store are transacted directly with Static Archive. Shopify is not responsible for any sales-related aspect between you and Static Archive, including any injury, damage or loss arising from purchased products. By using the Services, you release Shopify and its affiliates from all claims, damages and liabilities arising from your purchases and transactions with Static Archive.

Article 10 — Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information regarding your use of the Services in order to provide and improve them. Information you submit may be shared with Shopify and other third parties, which may be located outside your country of residence, in order to deliver our Services to you.

You agree to indemnify, defend and hold harmless Static Archive, Shopify and their respective affiliates, officers, directors, employees and agents from any claims, damages, liabilities or costs — including reasonable legal fees — arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

If any provision of these Terms is found unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

Article 19 — Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with any policies referenced within them, constitute the entire agreement between you and Static Archive regarding your use of the Services, superseding any prior agreements or communications.

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign or transfer these Terms without restriction.

Article 21 — Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
